Council Tax Application for Discount Disregard - Persons in Detention

Persons in detention may be disregarded when totalling the number of adults in your household for the purposes of deciding entitlement to a discount. A discount may be granted if the number of adults in the household is less than two.

A person may be disregarded for the purposes of discount whilst held in detention in any of the categories shown below:

(a) detained in prison, hospital or some other place by order of a court.

THOSE SERVING SENTENCES FOR NON-PAYMENT OF FINES OR COUNCIL TAX WILL NOT BE DISREGARDED.

(b) detained pending deportation under the Immigration Act 1971.

(c) detained in a place of safety under the mental Health Act 1983.

(d) detained under a warrant issued under the Repatriation of Prisoners Act 1984.

(e) imprisoned, detained or in custody under the Army Act 1955, the Air Force Act 1955 or the Naval Discipline Act 1957, providing that, in the case of a person in custody under arrest, the arrest subsists for a period exceeding 48 hours and they are not under open arrest.
