Privacy Notice – Test Valley Borough Council Parking Services

Test Valley Borough Council is the Data Controller for the purposes of data protection legislation and we will only process your information where it is lawful to do so.  The purpose of processing your data is to deal with PCNs, and appeals, to operate the permit and season ticket processes and to manage the Council’s car parks and car parking functions.

If you have received a Penalty Charge Notice (PCN) the lawful basis for processing your information is for a task carried out in the public interest and the exercise of official authority vested in the Council by the Road Traffic Management Act 2004, The Civil Enforcement of Parking Contraventions (England) Regulations 2007 and the Road Traffic Act 1984 (and any amending legislation) and as regards on street penalty notices the delegated authority of Hampshire County Council.

If you apply for a residents parking permit or a car park season ticket, the lawful basis for processing your information for a task carried out in the public interest and the exercise of an official authority vested in the Council by the Road Traffic Act 1984 (and any amending legislation).  Where you fail to provide information to the Council, the Council may be unable to process your parking permit or season ticket application.

The categories of information the Council shall process may include but is not limited to:

  • Details of your vehicle such as vehicle registration number, vehicle make and model.
  • Vehicle registered keeper details such as name and address from the DVLA or hire/lease companies.
  • Contact we have had with you, such as any correspondence via email and post.
  • Images captured by the council’s civil enforcement officers (CEOs)(which includes body worn camera footage), and CCTV cameras.
  • Call recordings and notes/transcripts of telephone calls made to the council.
  • Some transaction information if you have paid for a parking service by credit or debit card.
  • Contact details you have supplied such as email address, telephone number etc.
  • Correspondence

Where the processing of your personal data includes information about ethnicity, race, political opinion religious or philosophical beliefs, trade union membership, sexual orientation (‘special categories of personal data’), the Council is processing the information based on the exercise of a function conferred on us by law and is necessary for reasons of substantial public interest. Where the processing of information includes information about criminal convictions, the processing shall be on the basis of your consent and / or when the processing is authorised by law.

Your personal information will be retained for 7 years after closure of your matter or transaction.

You have a legal right to request from the Council access to and rectification or erasure of personal data or restriction of processing about you or to object to processing.  You also have the right to portability of your data (where processing is based on consent, a contract or is carried out by automated means).  Where processing is based on consent, you have the right to withdraw your consent at any time.  The Council will only process your information for the purposes for which the information is collected. The Council will not transfer your personal information outside of the European Economic Area (EEA). Your personal data will not be subject to automated decision-making.
