Attachment of Allowances
Where a Liability Order has been granted and no payment arrangement has been made to clear the debt, an attachment to the councillor’s allowances can be made. The order allows the Local Authority to deduct 40% of the allowance, in accordance with section 18 of the Local Government and Housing Act 1989 and section 175 of Local Government Act 1972.
Even if a Liability Order has not been obtained, section 106 of the Local Government Finance Act 1992 imposes a duty on the councillor whose payments are two months overdue to make a declaration to that effect, and to refrain from voting, at any meeting where certain matters are being dealt with.
