Construction Sites
Noise from construction sites can be dealt with using separate provisions contained in the Control of Pollution Act 1974. By their nature, construction works are temporary in duration and, in many cases, the options available to restrict noise disturbance will be very limited. There is recognition of this in law and such complaints are dealt with in a slightly different way to most other noise problems.
Nevertheless, building contractors are expected to take reasonable steps to minimise disturbance caused, for example by restricting working hours and using appropriately silenced machinery and equipment. Best practice guidance is contained within British Standard BS 5228 "Noise and vibration control on construction and open sites". Where appropriate, the Council can place restrictions on contractors engaged in construction or demolition works using powers under the Control of Pollution Act 1974.
In order to assist in the planning and management of works, a voluntary procedure is available to any building contractor under section 61 of the Control of Pollution Act 1974 to pre-agree working methods with the Council.
